TERMS OF SERVICE
These conditions apply to products sold by Grimm Audio CV via the internet domains www.grimmaudio.com and www.grimmshop.com. Some paragraphs of this disclaimer are applicable to just one of the two domains.
1. RESERVE
a. We do not warrant or represent:
(i) the completeness or accuracy of the information published on our website;
(ii) that the material on the website is up to date;
(iii) that the website or any service on the website will remain available.
b. We reserve the right to discontinue or alter any or all of our website services, and to stop publishing our website, at any time in our sole discretion without notice or explanation; and save to the extent expressly provided otherwise in this disclaimer, you will not be entitled to any compensation or other payment upon the discontinuance or alteration of any website services, or if we stop publishing the website.
2. CUSTOMER DETAILS
a. Your account
You can request an account by clicking on 'My account' followed by 'Register', at the top of the website. If you forgot your credentials for the Grimm Audio webshop, a link to retrieve these is available by clicking on 'My account' followed by 'Login' and then 'Forgotten Password'.
To place an order, an account is required, and you need to be logged in at the webshop.
b. Change of address
You can update your address details online. After you have logged in on 'My account', click on 'Modify your address book entries', and you will be shown a form with your current address details. By clicking on 'Edit' you can change these details.
c. Privacy
Your personal information during the ordering and payment process is handled through SSL encryption in a secure way and is not shared with third parties.
d. Personal details
You may ask for retrieval of your personal information at any time by e-mail request for inspection. We will respond to your inquiry within 4 weeks. Your request for inspection, removal or modification of your data, can send be to [email protected].
3. PAYMENT
a. Payment methods
The available payment-methods are listed below.
The listed fee-percentage will be calculated over the total amount of your order.
(i) Paypal 4%
(ii) Wire transfer free*
* Bank costs are on your own expense, you must include these bank costs in your payment.
b. Payment safety
If you choose the payment method Paypal, your payment will be arranged through Paypal. The Paypal user agreement can be found via the following web page: https://www.paypal.com/ga/webapps/mpp/ua/useragreement-full. When payment method Paypal Express is selected in the Checkout you also agree to the Paypal user agreement.
c. Invoice
You will receive the invoice of your order by email. The invoice is also your proof of warranty.
Outstanding payments can be viewed when logged in on https://www.grimmshop.com or https://www.grimmaudio.com/shop by checking the 'Order History' in 'My Account'. If the invoice is no longer in your possession, you may request a copy by sending an email to [email protected] or by downloading it from the 'Order History' in 'My Account'.
d. Reminder
If a payment remains unpaid for too long time we will send you a reminder. When you do not arrange payment within 2 weeks after the reminder is sent, the order will not be shipped and will be removed from the system.
e. VAT outside European union
Orders with a shipping address outside the European union are charged without VAT. You are required to inform your country’s tax authoraties about your order and pay the local VAT and customs clearance fees.
4. DELIVERY CONDITIONS
a. Forwarder
We use PostNL for all global shipments. When the delivery can't be completed because of your absence, PostNL will drop an information card with further instructions. More info about the forwarder can be found at the following web page: http://www.postnl.com/help-support.
b. Delivery time
The delivery time varies per country, for an indication of the delivery time we refer to the following web page of the forwarder: http://www.postnl.com/Images/transit-delivery-times_tcm19-22834.pdf.
All orders will be shipped from the Netherlands, unless stated otherwise.
We offer packages to the forwarder on business days only. We try to offer orders placed before 11AM (local time The Netherlands) to the forwarder on the same business day except customized items. Customized items will have a notification about the increased delivery time in the item discription.
c. Delivery address
You may supply a delivery address that is different from the standard account (invoice) address. This address can be selected in the checkout phase of an order and will be stored in the customers account for future use.
d. Confirmation
You receive shipping confirmation by email, including a track & trace number. With this number you can trace the location of your order at any time after shipment. For further questions please contact [email protected].
e. Costs
The shipping costs are dependent on the destination, weight and the service of choice. Shipping costs are calculated in the checkout phase of the order.
f. Responsibility
Grimm Audio carries no responsibility for loss or damage during shipment. In case a shipment gets lost, you are required to inform Grimm Audio about this fact within 16 business days after the shipment has been sent. Grimm Audio will then assist in helping to trace the package via the PostNL service. In the checkout phase of a purchase you may buy an insurance to cover (part of) the cost in the unlikely event that the package is lost but can not be found.
g. Cancellation costs
Grimm Audio charges no cancellation costs.
h. Backorder
If (part of) an order is not available from stock, you will be informed about this in the 'Shopping Cart' section of the checkout phase. You may then agree to place a pre-order by pressing the 'Checkout' button on the Shopping Cart page. We will inform you about the expected delivery time by e-mail.
5. RETURN AND REFUND POLICY
A trial period of 14 days applies to all orders, except for custom cable assemblies and other custom/personalised products. This period starts on the day the package is received.
Should you wish to return your order, we ask you to:
- request the return in our webshop. (Go to: "My Account" -> "Order History" -> "View" -> "Return".)
- include your original invoice.
- return the undamaged product within the trial period of 14 days.
- provide track and trace information to prove that the order is returned within the trial period.
- include all accessories, such as cables and manuals.
- use the original undamaged packaging.
You are responsible for proper insurance for the return, if the order is lost on the return you are responsible for the loss.
The return shipping costs will not be covered by Grimm Audio.
After reception of the order in good condition we will do one of the following:
- If the shipping address is inside the European union, we will refund the paid amount within 14 days.
- If the shipping address is located outside the European union, we will refund the purchase price, excluding shipping costs, transaction costs, VAT and customs fees, within 14 days.
- If the product is damaged or the packaging is damaged more than necessary to try the product, we may pass on this reduction in value of the product to you.

After the 14 days trial period the purchase agreement is final and the refund right expires.

7. LIMITATION OF LIABILITY
GRIMM AUDIO SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, SPECIAL OR INCIDENTAL DAMAGES (INCLUDING BUT NOT LIMITED TO DAMAGES FOR PERSONAL INJURY, LOSS OR DAMAGE TO ANY ELECTRONIC OR AUDIO EQUIPMENT, LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, AND THE LIKE AND WHETHER ARISING IN CONTRACT, TORT OR OTHERWISE) ARISING OUT OF THE USE OR INABILITY TO USE THE PRODUCT EVEN IF GRIMM AUDIO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
8. APPLICABLE LAW
Any disputes, including interlocutory proceedings, related to and/or arising from this agreement will be brought exclusively before the competent Court of Amsterdam, The Netherlands, to the exclusion of any other court of law.
